What St. Clair County Bankruptcy Records Contain

Bankruptcy case files are detailed public records. Every St. Clair County case begins with a petition that identifies the debtor by name, address, and Social Security or tax ID number and states which chapter was filed. Schedules list all property and all debts. The means test (for Chapter 7 cases) shows whether income qualifies for a liquidation discharge. The statement of financial affairs discloses recent income, transfers, and financial history. All of these are required federal forms and they become public records the moment they are filed.

As the case moves forward, more documents get added. The 341 meeting of creditors is scheduled early in the case and the result is noted on the docket. Creditors can file proofs of claim, especially in Chapter 13 cases. The trustee files reports and, in cases with assets, distribution records. Chapter 13 filers submit a proposed repayment plan that must be approved by the court and may be amended during the case. Any motions filed by either side, including relief from the automatic stay, are also part of the public docket.

The case ends with a discharge order or a dismissal. The discharge order identifies which debts are eliminated. For St. Clair County residents who are lenders, employers, or landlords verifying a person's bankruptcy history, this document is usually what matters most. It is stored in PACER and accessible as a public record.

Filing Fees and Record Access Costs

Filing fees are set at the federal level and are the same throughout the Eastern District of Michigan. Chapter 7 costs $338 to file. Chapter 13 costs $313. Filers whose income is below 150% of the federal poverty guideline can apply for a fee waiver by filing a form with their petition. Installment payment arrangements are also available with court approval.

For Chapter 13 cases in the Eastern District, the standard No-Look Fee for attorney compensation is $3,500. Courts use this as the presumed-reasonable flat amount. More complex cases may result in higher fees if the court approves them.

Getting copies of records outside of PACER has separate costs. PACER access at home is $0.10 per page up to $3.00 per document, with quarterly bills under $30 waived. Free terminal viewing at the courthouse, with printing at $0.10 per page. Staff copies are $0.50 per page. Certified copies cost $12.00 plus $0.50 per page and are needed when using the document as official proof, such as verifying a discharged debt with a lender or in a legal proceeding. Mail request instructions are at mieb.uscourts.gov/obtaining-copies-documents.

Michigan Bankruptcy Exemptions

Michigan law protects certain property for bankruptcy filers. The key exemption is the homestead protection under MCL 600.5451, which shields up to $46,125 in home equity from creditors in a Chapter 7 case. The cap rises to $69,200 for filers who are 65 or older or are disabled. St. Clair County has a range of home values, including areas in Port Huron, rural townships, and waterfront properties along Lake Huron and the St. Clair River. The exemption amount matters when deciding between Chapter 7 and Chapter 13.

MCL 600.6023 covers additional personal property exemptions: clothing, household goods, one vehicle up to a set cap, tools of a trade, life insurance, and most retirement funds. Federal exemptions under 11 U.S.C. ยง 522 are also available as an alternative set. You must choose state or federal and apply one set consistently. Mixing the two is not permitted. A bankruptcy attorney can compare both options for your specific situation and help you decide which gives you the best outcome before you file.

Exemption amounts may be updated periodically. Check the current statute text or consult an attorney to confirm the figures before relying on them.
