PACER is the main online system for searching federal bankruptcy records. It stands for Public Access to Court Electronic Records. You can use it to find Lake County bankruptcy cases filed in the Western District of Michigan. PACER gives you access to dockets, filed documents, and case status information.

What Lake County Bankruptcy Records Contain

Bankruptcy records from Lake County cases include a wide range of court documents. The petition is the first document filed. It starts the case and lists the debtor's name, address, and the chapter under which they are filing. The petition is public record and shows up in PACER right away.

The schedules are detailed financial disclosures filed with the petition. Schedule A/B lists all property the debtor owns. Schedule C lists what the debtor claims as exempt. Schedule D covers secured debts. Schedules E and F list unsecured debts, both priority and non-priority. Schedule I and J show monthly income and expenses. These documents give a full picture of the debtor's financial situation at the time of filing.

Other documents you will find in a typical case include the Statement of Financial Affairs, the means test form, and the credit counseling certificate. Chapter 13 cases also include a repayment plan. The plan shows how the debtor proposes to pay creditors over three to five years. The trustee and creditors can object to the plan before the court confirms it.

Meeting of creditors notices (also called 341 meeting notices) are part of the record. These show when and where the initial creditor meeting took place. Discharge orders are among the most requested documents. They confirm that eligible debts have been wiped out. Dismissal orders show when a case was thrown out. All of these records are part of the permanent court file kept by the Western District clerk's office.

Filing Fees for Lake County Bankruptcy Cases

Federal bankruptcy filing fees are set by Congress and are the same across all districts. Chapter 7 costs $338 to file. Chapter 13 costs $313. These fees cover the filing of the petition and the administrative costs of the case. Chapter 11 cases carry a much higher fee. Michigan Bankruptcy Exemptions for Lake County Filers

Michigan law sets out the property that debtors can protect in bankruptcy. Lake County residents use the Michigan state exemptions, not the federal exemption set. Michigan has opted out of the federal exemptions, so state law governs what you can keep.

The homestead exemption under MCL 600.5451 lets you protect up to $46,125 in home equity. If you are 65 or older, or if you have a disability, that amount goes up to $69,200. The home must be your primary residence. You claim this exemption on Schedule C when you file your petition.

Michigan's alternative exemption statute at MCL 600.6023 covers other types of property. These include household goods, clothing, tools of the trade, one motor vehicle up to a set value, and certain retirement accounts. Retirement accounts held in ERISA-qualified plans are generally fully protected regardless of the dollar limit. Social Security benefits, disability payments, and pension income are also protected under state and federal law.

Choosing the right exemptions matters a lot in Chapter 7 cases. A trustee can sell non-exempt property to pay creditors.
